Terms and Conditions

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User") and TapFunds (the "Platform," "we," "us," or "our"). By accessing or using this Platform in any manner, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must discontinue use immediately.

1. Description of Services

TapFunds is an independent loan request and lead generation platform. WE ARE NOT A LENDER, BANK, CREDIT UNION, MORTGAGE BROKER, OR FINANCIAL INSTITUTION. We do not originate or fund loans, make credit decisions, set loan terms, issue loan approvals, or disburse funds.

Our sole function is to receive consumer loan request submissions and transmit that information to our network of third-party lenders and financial service providers who may evaluate your request. Submission of a loan request through this Platform does not constitute an application for credit, and does not guarantee that you will receive a loan offer, be matched with a lender, or receive any particular loan amount, APR, or repayment terms.

2. Eligibility

To use this Platform, you must:

  • Be at least 18 years of age, or the legal age of majority in your state, whichever is higher
  • Be a legal resident or citizen of the United States
  • Have a valid Social Security Number (SSN)
  • Maintain an active checking or savings account in your name at a U.S.-based financial institution
  • Possess a valid email address and active telephone number
  • Not currently be a debtor in any active bankruptcy proceeding

By submitting a loan request, you represent and warrant that you satisfy all eligibility requirements above. We reserve the right to refuse service to any user who does not meet these criteria or who provides false or misleading information.

3. Accuracy of Information

You agree to provide true, accurate, current, and complete information in all fields of the loan request form. You acknowledge that providing false or misleading information may constitute fraud under applicable federal and state law and may result in civil or criminal liability. We are not responsible for any consequences resulting from inaccurate information you provide.

4. Third-Party Lender Relationships

TapFunds works with a network of independent third-party lenders and financial service providers (collectively, "Lenders"). These Lenders are not affiliated with, employed by, or acting as agents of this Platform. You acknowledge that:

  • Each Lender independently determines its own eligibility criteria, rates, fees, and loan terms
  • We have no control over any Lender's approval decisions, interest rates, fees, or terms
  • Any loan agreement you enter is solely between you and the applicable Lender
  • Lenders are independently responsible for compliance with all applicable federal and state lending laws
  • We are not responsible for the conduct, acts, or omissions of any third-party Lender

We strongly encourage you to carefully review all loan documents and disclosures before executing any agreement with a Lender.

5. No Guarantee of Loan Approval

Submitting a request through this Platform does not guarantee any of the following:

  • That you will be matched with any Lender
  • That any Lender will approve your application
  • That you will receive any specific loan amount, APR, interest rate, or repayment schedule
  • That any particular loan product is available in your state of residence

All credit decisions are made solely by independent Lenders based on their own proprietary underwriting criteria.

6. No Fees to Users

Our services are provided to consumers at no cost. We do not charge application fees, origination fees, or any other charges for submitting a loan request or being connected with a Lender. We receive compensation from our network partners when a successful connection is made. This compensation may influence which Lenders are included in our network but does not impact the accuracy of information we provide or affect your consumer rights.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW,

TapFunds, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THIS PLATFORM, REGARDLESS OF WHETHER SUCH DAMAGES WERE FORESEEABLE.

Our total cumulative liability to you under these Terms shall not exceed one hundred U.S. dollars ($100.00). Some jurisdictions do not permit certain liability limitations, so these limitations may not apply to you in full.

8. Indemnification

You agree to indemnify, defend, and hold harmless TapFunds and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to: (a) your use of the Platform; (b) your violation of these Terms; (c) any information you submit through the Platform; or (d) your violation of any applicable law or the rights of any third party.

9. Intellectual Property

All content on this Platform – including text, graphics, logos, and software – is the proprietary property of TapFunds or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from any content on this Platform without our prior written consent.

10. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Delaware (or such other state as designated by the operator), without regard to conflict of law principles. Any dispute arising from these Terms shall first be subject to good-faith negotiation. If unresolved, disputes shall be resolved through binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION OR REPRESENTATIVE PROCEEDING. If the class action waiver is found unenforceable, the arbitration provision shall be void as to that dispute.

11. Modifications

We reserve the right to modify these Terms at any time. Changes are effective immediately upon posting. Your continued use of the Platform following any update constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically.

12. Severability

If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions will continue in full force and effect.
